A small oversight can change the outcome of an injury case, even when everything else was done right. This post covers why it matters to tell your healthcare provider how you were hurt, and why that detail should be written in your medical records.

Frequently Asked Questions

Can a small mistake cost you part of your case?

People have made mistakes that really affect the outcome of their case. Take someone who is doing everything right. They got in a wreck, and it was not their fault. They collected themselves and got out. They talked to witnesses. They got pictures.

They went to the emergency room or the urgent care to get treatment. But then they forgot to mention they were in a wreck or that they fell, and that the injuries were being caused by the wreck they were just in.

So it’s important to lay out the path of the injuries and why you have them. It’s important to document why you’re at the doctor and why you’re at the urgent care, and to explain to the doctor and the nurses, “I was doing well before this. I wasn’t hurting. I didn’t have this kind of pain until that bozo ran the red light and hit me.”

That should be in writing. The doctor, the healthcare provider, should put that in writing, because later, if the case is in court, in discovery, in litigation, the other side is going to bring up these records. They will point out that the wreck is never mentioned, or that slipping at the store and falling and hurting yourself is never mentioned.

It’s a small thing, but it’s an important thing. Don’t make that mistake. If you are hurt because of somebody else’s fault, make sure that when you get to the doctor, you mention why you’re there and why you’re having this pain.
