Getting medical treatment and diagnostic testing after an injury can support a claim, and delays or gaps in treatment can work against it. These videos cover when to get looked at, why imaging such as an MRI can matter, and what can hurt an injury case early on.

Frequently Asked Questions

One of the biggest mistakes after an injury?

Getting medical treatment is one thing that can help. Go as soon as you can after you’re injured. Don’t wait a month. People who are hurt, go get looked at. It can help you heal better. It can give you peace of mind if nothing else.

Another thing that jumps out is diagnostic testing. If you’re still hurting, with problems, numbness, tingliness, something like that going on two or three weeks later, you need some diagnostic imaging. Mention that to your doctor. They’re the ones who have to order it.

But think about an MRI. That’s going to show a lot of soft tissue things, nerves, disc, muscles, tendons. The X-rays don’t. So get that done because that’s objective. You’re going to hear from the other side, is there any objective test other than you just saying it?

If that gets done, it can take away their argument, and you have something scientific supporting your argument and your claim about hurting and numbness, difficulty walking, all kinds of things. So, get the test.

What can hurt an injury case early on?

Let’s say somebody gets in a wreck January 1st and now they’re not seeking treatment. They’re just staying at home doing things to help out with the pain, but never going to a doctor to document that they were actually in a wreck.

Never going to a doctor and getting treatment to get better. And also talking to the insurance company for the last 3 or 4 months, wherein now the insurance company’s got these recordings where they’re manipulating them into saying things, and they don’t have any kind of a medical history showing that this car wreck actually hurt them. Those are a couple things that are really, really going to hurt your case.
