Chad Jones talks about what it means for a case to go wrong and why that often depends on perspective. He explains that a person’s account can differ from what the evidence shows. He also describes a crash involving an 18-wheeler where an investigation changed the story.

Frequently Asked Questions

What’s the fastest you ever seen a case go wrong and why?

It probably depends on your perspective, right? Because facts are facts. There’s an old saying, yeah, you can have the law on your side, but the facts are what the facts are.

As far as a case going wrong, if somebody comes in and says ABC happened, but it turns out it was XYZ, that’s wrong. A lot of times people aren’t lying. It’s just perspective. It’s just adrenaline. What happened in the moment?

Maybe they can’t acknowledge that they messed up, but the firm will get the videos, get the crash report, talk to the police officer, talk to witnesses, and let them know, “Hey, here’s what the evidence is going to show.” And most people are like, “Okay, I guess I got that wrong.” But it’s good. The firm found out, gave them the information, now they know, and they can go about their lives.

Where something’s gone right right away, one that pops into mind is a similar situation. There’s a big 18-wheeler driving in a turn lane for a long time and at a high rate of speed. The client pulls out of a gas station to go across the traffic that’s stopped and into the turn lane and is going to proceed to cross that turn lane when the 18-wheeler hits them.

The defense attorney for the truck driver is like, “Listen, your people pulled out when they shouldn’t have. My guy is driving fine.” And at first glance, you might think that’s right. But the firm sent investigators out to the scene, put some signage out, and talked to witnesses, because people tend to make the same path, right?

The firm ran into somebody that had been there at that wreck a few days before and they happened to have a camera in their car recording the whole thing.

That camera and that recording changed the story. It showed this 18-wheeler way back in this travel lane too long and driving like 40 mph at the turn lane. It was an inevitable crash. So that went right in a hurry because the firm got out there and did the proper investigation.
